As per the Section 11 of Cr.P.C. the State Govt. may likewise establish for local area one or more courts of Judicial Magistrate First Class or Second class to try paticular cases of paticular classes or categories of cases. --

Magistrates in Group-A Category by status with judicial powers are called Magistrate 1st Class. District magistrates as Magistrates of First Class.The official seal, which such Magistrates use, also incicates their being of 1st Class Category. SDM's in Sub-Divisions are normally of 2nd Class and tehsildars in a state are treated as 3rd Class magistrates.
