A laboratory which does not have permissions

(Querist) 03 October 2010 This query is : Resolved
A prestigious laboratory funded by Govt of India was reporting on crime scene samples on the false grounds that it can receive crime scene material for giving an opinion. Evidence on several sensational cases have been reported from this Laboratory. Now it is clearly admitted by that said laboratory under RTI, that it does not have any approval, authority or permission from Govt of India to carry out examination and report on crime scene samples and it was doing it since the Police and Courts were forwarding the crime scene samples.. So my question is what will be fate of the 1000s of reports issued by this laboratory and will it be treated as Evidence.
s.subramanian (Expert) 03 October 2010
They will be considered as reports by unauthorised and unapproved agencies and looked at by the courts with a sense of suspicion only.
Devajyoti Barman (Expert) 03 October 2010
I think some larger issues are involved in it. Only the higher court can determine the admissibility of its report.
Kiran Kumar (Expert) 03 October 2010
apprise the authorities including the High Court about the actual status of the laboratory.

this issue needs proper investigation and adjudication after all its a matter of protection of Human as well as Constitutional Rights.
Dr G V Rao (Querist) 03 October 2010
Yes i too suspect that larger issues are involved within this laboratory. I totally agree with Mr Barman on this yes I shall approach the High Court as per Mr Kiran Kumar's advice but am worried abt the time it will take for the High Court to pass orders. Meanwhile I think I will write directly to CJI so that he might take it as a PIL and hear me.

Dear All,

To my mind the best way is to approach the High Court in its writ jurisdiction to get the position settled for once and all.
Best Regards
