A web developer not completed the task and not refunding the advance money

Dear Sir
I need your advice in following case:
I had approached a web developer on 21st Feb 2016 for getting a website developed. I paid him 5000rs advance on 21st feb itself. He told me that he will hand over me the project within 15-20 days ( only verbally i dont' have any documents to support this except my friends who were present there while we were discussing) . Even after 45 days when he didn't complete my website I gave him further 7 days time line and told him that if he doesn't complete the task within these 7 days I will take my project back from him. When he didn't complete I asked him to return the advance money that I had paid but instead of returning the money he is accusing of false baseless alegations that I have stolen his code and that he will complain to cyber cell and will take hisrest of the money.
His allegations are totally false and baseless. Due to his not completing my task I have lost my precious 45 days ,beside this I had planned to market my website and had given order for flacks, pamphlets ,cards. etc. I am incurring heavy lossess .
He is not a registered web developer and doesnt pay any type of tax to govt.

Pleas help me how can I get my money back and compensate my loss.

send lawyer legal notice to him to refund ur advance amount in 30 days time.

You can file case of cheating and fraud on this issue.
Alternatively you can file case in consumer forum wherein you will apart from getting refund of the money will be awarded with compensation and damages as well.
