Sir,
Myself and my father is accused under Sec 520 and 506 I.P.C. allegedly filed under Section 156(3) Cr.P.C making false claim that she has paid money to us and not registering the property in her name. She (my sister) for the sake of grabbing land from us filed a false case. There is no written documentary authoritative proof of the said receipt of money except interested witnesses and forged signature unregistered deed stamp papers. At the time of filing of criminal petition the said original document is under the court custody at other place. The Police Station I.O. in his report has written investigation completed and accused is produced before the court and filed charge sheet on the basis of xerox copy of the document. Till date the original document is still lying in the Civil Court. The case has come for appearance and recently my father expired I filed Registered death certificate of my father for abatement.
Under these circumstances can the name of my father in the present criminal case is abated or his name will be continued for any liability after informing the court.
Thanking you,
MSN

Please read Section 420 Cr.P.C. instead of Section 520 Cr.P.C.
