about dyeing declaration.

Sir, I want to humbly know that can a person's dying declaration is always right? I know one case that there is a false statement given by a lady who was in last stage of life. she want to punish his son-in-law due to love marriage.how we save our client. please guide me.

There is an very old Lahore Privy Council case, where dying declaration of a person was not believed by the court. It was a very interesting case, search that. I studied it long time ago, will try to get it.

There is saying in our God's own Country, a great granfather before dying exprssed his lase wishes. In order to get peace to his departing soul his body must be pirified with iron road so that evil spirits won,t disturd. The beloved son, daughter, son's children and daughter daughter etc did that immediatly after his death. They took an iron road and pluged it in the body through anus to head. When that was found out during the burial all beloved children were arrested for murder of the grandpa. So all dying declarations are not trust worthy. some tests are applied before taking that in to consideration.

It is not safe to convict an accused person on the evidence made by a dying declaration without further corroboration because the maker of it might be mentally and physically in a state of confusion.
