sir i dont have house & shop owned by me i am residing in a father in laws house
as per mah. vat act i have applied for same officer is denieng on the basis that i must have own property can he deny on the same ? if i dont have money to purchase property i can not do the business ? does constitutionely he is right?

you have to make an application forregistartion asa dealer .


have you made any application under section 16(2)for registartion as a dealer to prescribed authority?

has your application for registration been rejected / were you grnated a personal hearing ?

Matter is only of the residential address and having a property at the place wherein you have applied for the VAT registration.

I am of the firm view that the approach of the concerned official is erroneous and you need not have your personal property as a precondition to get your registration under VAT Act. You may prefer an appeal before Commissioner against the denial order of such officer.

i have appllied U/s 16(2) of MVAT but officer is saying that own property is must

The reply of the office is erroneous so move an application with the commission and get the desired remedy.
