About sale deed

(Querist) 05 October 2013 This query is : Resolved
Sir, when two persons are buying a property jointly, then is it possible to write a condition in the sale deed that none of the two can sell his share of the property without taking consent of the other one. That is, later on, if one of the joint holders wants to sell his share of that property, divided or undivided, he cannot do so without taking the consent of the other joint holder.

Sir, with reference to the above query, if such a condition is mentioned in the sale deed, would it be sufficient to prevent the other joint owner from selling his share without the consent of the first owner or something more will be required. In what circumstances can one joint owner ignore this condition and sell his share without the consent of the second joint owner.
Rajendra K Goyal (Expert) 06 October 2013
All depends upon the conditions mutually agreed in the document.
