About the warranty of the vehicle

Dear sir my neighbor purchased a vehicle "TATA Ace" from TATA copmany (vadodara- Gujarat) before 2 moths ago. Before 5 days ago the vehicle break down in the way and than after the owner called a mechanic to solve the problem but the mechanic said to him that it's looks like a major problem so don't waste your time and call the service department of such company, Than after the village of the owner is 120 km away from the service department so the service department guided to the local mechanic to do as he say on the phone the local mechanic followed him and than he said that there is a problem in PUMP. After such incident the vehicle send to the service department and after checking it they found the problem in pump so they send such pump to the manufacture company to solve the problem, after sending the pump the manufacture company replied that the owner used "kerosene" instead of "Diesel" therefore they are not responsible for such defect and to solve such problem they demand 15.000/- Rupees to change the "Rotor" which is found defective. The TATA company has given the guaranty of the vehicle accept electronic materials and the pump because pump is not manufactured by the TATA company but they wrote in service book 1 year or 32.000/- km what ever earlier will be fall under the warranty/guaranty as the company deems fit and manufacture of the others part of the said vehicle will also be responsible for the same: So now what advise should be given to the owner to claim, Should he moved to the consumer forum or give the prior notice to such company and if notice should be served to him so to whom notice should be given either the TATA or the manufacture company of the pump. Please help me out.
The owner never used kerosene instead of diesel in the vehicle.

Dear querist
first of all send a legal notice to company and demand compensation, if they are not ready to pay after that file a complaint before consumer court or file a suit for damage, suit for specific performance before court.

usually TATA service.s do not make such foul play to escape from warranty.
are you sure that keresone was not used?
It is possible that the fuel was adulterated without even your knowledge.
Initially make a representation to the tata customer service stating all the facts and if it does not solve your case,raise a consumer complaint.

If the manufacturer of the pump (Which is not Tata) has deduced after inspections that Kerosene was used, the warranty would stand void, Tata won't take onus on itself for the same.
If you have any grievance, you can get more reports on this particular pump and then proceed with issuing notice.

the company now ready to change the pump without any notice, just call them and problem solved the denied first but than after arranging the meeting of the staff and they have taken this decision.
