Abusing over the phone by mts collections dept

Hello all please respond as soon as possible...My name is abhishek and the reason for this mail is to let you know that i have been receiving harrasment calls and one of the executive spoke in such a way that she asked me if i was Narendra modi or Abhishek bachan (i have call recording of the call where the executive has agreed on calling me such names) I have not payed the bill as the services were not provided as per their promise and on proper time frame(i have snapshots of the speed issue as well)and i have clearly told them that i will not pay the bill untill an apology letter is sent by the executive who called me those names..but i have been receiving threat calls saying that i will receive legal notice from a lawyer from MTS how to face this issue please get in touch as i am ready to face this issue legally.
My questions are
1.can a telecaller from colections department call me such names which would really hurt my feelings even if the bill is not paid.
2.There was four complaints raised since the day one i took the connection and not even a single time a technician visits my place to determine the problem.
3. The complaints are closed without my knowing and asking me if the issue is solved or not.
4. And can i ask MTS for my final settlement bill and clear my account even if the bill is pending( as i dont want to deal with those people anymore
5.I received a call from head office saying that the telecaller has not done any mistake and she said that calling me such names is not a mistake.
6. Should i pay the bill even after all these harrasment calls i have been receiving.
7. They are telling that i have used the data as per their plan so i have to pay the bill,,,but the main problem was that i had to sit during late nights like 1 am to 5 or 6 am to use the internet as that was the only time that i used to get speed which also resulted in back pain and other medical complications.
8. they are claiming that its my fate that i had to use the internet during nights but i explained them how can i use during day times when there is no proper speed not even 5% of the speed promised by mts..they said speeds of 9.8 mbps but the max i got was 114 kbps during nights and 2kbps-50kbps during day hours

Please i know its a long list of questions but please help me..if you want i can post the call recording and snapshots of the speed that i used to get to ur mail id for ur inspection on how the lady spoke.

You may report the issues to TRAI and let regulator take an action.

For service related issues you can pull them to DCDRF.

For misbehavior you can lodge police complaint..........and let the police call this person to police station along with local BM/recovery-collection manager.



In case of one complaint of M/s Vodafone the Dy.manager alongwith BM rushed to police station.

They ended up spending more than they had to collect.

Ok i will put it in simple ways
1.I took a connection of MTS in the month of October, Since then i was not able to browse properly during day time as the speed of the internet was slow.But the speed was ok during late hours i.e,from 1 am onwards
2. I have reported this issue to the customer care dept not once but four times,even though the issue was not resolved and not even once the technician vist my place to see what the problem was
3. The Complaints were closed without asking me whether the issue was resolved or not
4. The technicians who were supposed to visit my place dint even come once to see what the problem was. All they did was they called me and said that they are running some online tracking and simply said that the internet speed is optimized to the maximum extent and said that what ever speed i am getting is proper
5.Because of all the above problems i made a decision to hold the payment of bill until a technician comes to my place and see what exactly the problem i had with their internet connection, but no one has ever come.
7. The Main problem here is the speed is worst during day times( takes a minute or more to open a webpage and the speed range from 0 to 40 kbps) but the speed were ok(not as promised) during late hours.
8. i used to browse only during late hours and i agree that i have used data
9. when i informed the same to a collections agent the reply was that its my fate that the speeds are fine only during night times,hence i have used data and its my problem to clear the bill
10. On the same conversation i said to the collection agent stating that i will proceed legally through consumer court and get this issue resolved and her reply was "Oh Oh Oh Neev en Narendra Modi na, neev en abhishek bacchan ah? " Which means are you Narendra modi or Abhishek bacchan in kannada
11. I have the call recording of the conversation where the agent has agreed on calling me such names
12. I have the snapshots of the speed i used to get.

My questions are
1. Is it ok a telecaller from collections dept calling me such names.

2.Can i ask for an apology letter from the lady executive who spoke to me in such way

3. Should i pay the bill even after all these harrasment

4.If I "CONSIDER" PAYING THE BILL, i have a bill amount of 2116 pending and is it allowed to ask me for a final settlement bill for paying the bill amount( as i dont want to deal with those sarcastic people anymore )

5. If I "COSIDER" Not paying the bill and if i receive a legal notice, can i counter reply through a legal notice sent by me

6. Can i send a legal notice by my own as i dont want to incurr any lawyer fee

7. if i can send a legal notice will some one guide me in how to do it, guidelines and all the requirements to do so.

8. Is there someone who can handle this case and let me know if there are any odds on me for not to win this case.

9. does sending a legal notice from my end prevail any positive response from MTS.

10. are there any lawyers on this forum who would take up this case with out any fee( I know nothing comes for free now a days But please i need help because i am not a working professional nor a business man i am just a student who is in search of a job )Please by gods grace some one help me.

log onto website of TRAI and download the rules.

You can seek help from Distt. legal Authority that might have office in court complex.
