Accident case

Dear sirs,my son in law did an accident to one old person and he was died, in postmortem report they have mentioned that he was dump and died with head injury.sir my son in law Has been arrested under Section 304a ipc. Sir what is the case cycle, can we do settlement after two or three hearings. Please advice me,sir public was interfered on the road and damaged the vehicle and injured head to one kid. my sisters hand factUred and they were addmitted in hosptal. So please suggest me. Thankyou

Normally, in accident cases, the police will prosecute under the Criminal procedure and the victim side also may sue for compensation.

If there is no violation of Insurance policy of your car, ultimately, the insurance Company is liable to pay compensation.

As for as the police case is concerned, if your son in law feels that no wrong is done from his side, he can defend the case before the court.

Note that your son in law has to participate in the case proceedings regularly and conduct the same properly to avoid risk and liabilities.

The case is of life and death. No court will complete it in two or three hearings as you are wishing. The case cycle we can not predict unless we are in court to monitor the hearings.
Employ a criminal lawyer. Once done he is duty bound to defend your son-law whatever be the odds against your son-in-law in the in the case.
