Sir,
I had filed RTI application for getting sanctioned plan and enclosed permission letter/ file no copy which my father had taken in the year 1995.
Now i got reply form Town Planning section stating that sanctioned copy plan is not available in their records.
If they don’t have sanctioned copy and i think don’t inspect my house and they cannot say that house was constructed by deviation of sanction plan.
Now that question is false compliant was filled against me, now i would to like to file defamation case against this person.
So please inform weather i can lodge defamation case or not and if yes, how much will be the amount to be asked in court of law.

You are silent about the person who lodged the complaint.
Only because the copy is not available with the Municipality does not mean that you did not deviate from sanctioned plan.
However it would help you to defend yourself in case the Municipality starts any action against you but the same is not sufficient enough to bring defamation action against the complainant.
