Adding name for equal rights in property purchased

Respected sir/mam
My family originally consisted of 2brothers.
1st brother had 3 sons
2nd brother had 1 son.
2nd brother's son is my father.
The 2nd brother died at a very early stage say about 40yrs ago and after the death of 1st brother the family disputes started
My father wants to claim equal right in all propertys as the property purchased were to be equally divided between two brothers
Now the thing is in good faith the property were purchased by the name of any person from the family.
Now the other people refuse rights stating the property were purchased undrr their names.

are you referring to division of ancestral property in your family or is it self acquired property of any one of the brothers or brother's sons?
in order to be ancestral property,the property should satisfy the test of 4 generations-the great grand father to grand father to father to son.
if the property you are referring does not satisfy the above test,then it is the self acquired property, on which the owner has absolute right of disposal by way of transfer/gift/will.

The property is in the name of individuals, it would be treated as their self acquired property. You or your father can not claim it.

However, if the property is ancestral the position would be different.

Sir.the property were purchased when my grandfather n his brother were alive
However during that time the property were purchased under names of sons or daughter in laws of my grandfathers brother.
