(Querist) 12 November 2013 This query is : Resolved 
The resident welfare society in gated community flats asking for additional money for so called development. But there is no written commitment nor agreement between residence and society on what developments they are planned to do. However they are distributing the palmplets & rough slips to all residence in order to collect money.
In case if any resident dont pay in time,they threatening for penalty.

As a resident do we have option not to pay
and if there it is to pay how do we safegaurd the money is being utilised for the real development?

Experts kind advise please.

ask for audited accounts of money spent on development . interest can be charged if there is provision in byelaws adopted by society

Get the resolution passed by the society about proposed development and the estimated expenses. Also you can ask the Audited Accounts.

Society members individually as well as collectively have legal right to know the purpose of collection of dues and its utilization so office bearers of the society management can be enforced to provide entire details of their so-called development work.

Agreed with Mr.Rajkumarji Makkad. You should have trust in the office bearers of residents welfare society when you are living in a gated community and when you are a member of the society. You can easily ascertain whether the request is authorised one or not by verifying the resolution. As regards verification of end-use of funds, being the member, you can also join in the development activity or the office bearers will present the account in the General Body. You can get the clarifications from them if you have any doubt.
