Adoption

(Querist) 09 February 2013 This query is : Resolved
Respected learned members,

Since years back, an orphaned girl has been living with my Uncle & Aunty who doesn't know /remember her parent/place/relatives etc. She only knows now that Other than my Uncle & Aunty as Parent and their children as her brothers and sisters, there is nobody related to her in this world.
Now the question is, she is matured enough to get married aged about 23 years. My Uncle & aunty want to fix her marriage now. Now, how do they adopt her legally or otherwise, or is there any other instrument to make her the daughter of my Uncle & Aunt legally, so that they could get her married, and one more important thing is to get her Elector Photo Identity card. Please suggest.

You have not stated if the girl is of same religion or not. One cannot adopt a person from other religion.

They cannot adopt a child above age of 15.

One cannot be denied entry in voter list if the name of parents is not known. There are people who grow up in orphanages.

Where is the sense in adoption when she is 23 years.

Let her get married & live life with her husband.

Nobody stops you having her company, or you giving any property
OUT OF LOVE & AFFECTION, AND BY WILL

what was your uncle doing for so many years ? he cant adopt the girl now . she is already 23 years old . let uncle make a will in favour of the girl

You uncle can get registered the adoption deed even at this stage mentioning therein that he had adopted this girl when she was having the age below 10 years but no documentation could be made at that time and because her parents are no more so she be treated as their daughter.

One another way is also to get a decree of declaration from court against general public by filing a civil suit stating therein the same plea.
