Adoption rights

(Querist) 05 March 2012 This query is : Resolved
Hi Every One,
My aunt and uncle had adopted a kid 18 years back. The kid is now 23 years old. and my aunt is no more today. My aunt was a employee and has written a will of 50% each for all movable property. Imovable property acquired by her is mentioned that it should go to hew son.

Will my uncle get a share in the imovable property?

No - the will ousts the uncle vis-a-vis the immoveable property

I checked with the employer. There is a housing loan, a due of 10L, which will be settled in final settlement agains pf and qratuity. The employer also says that acording to their company's housing society law, the imovable property will be tranfered only to the spouse and not to the adopted son.

was adoption done by adoption deed/ was agreement regsitered?

if in will mentioned that property should go to adopted son obtain probate of will
Raj Kumar Makkad (Expert) 06 March 2012
The law of land shall prevail and not of the company. Who is the company to make rules against the policy of State?

Will shall prevail and accordingly 50$ share shall go to adopted son and rest of share shall go to husband of deceased.
