Advocate failed to argue the case and withdrew the case

I ENGAGED AN ADVOCATE TO FILE A WRIT PETITION IN THE HIGH COURT. ON THE DAY OF HEARING THE ADVOCATE CAME UNPREPARED. THE ADVOCATE COULD NOT ARGUE THE MATTER AND REMAINED SILENT STRUGGLING TO FIND AN ANSWER AND ON THE CONTRARY WITHDREW THE CASE. I HAVE A STRONG CASE BUT THE ADVOCATE CAME UNPREPARED. CAN I FILE THE WRIT PETITION AGAIN THAT THE ADVOCATE WITHDREW THE CASE?

Even If the Advocate was Not Prepared He Could have Requested the Court and Would have Taken More Time to file the Same and Normally the Court would Grant the Same.Your Complaint is Un Believable.

u can re-open writ by filing application under section 151 of cpc in court that ur advocate withdrew it without ur instructions.

Instead of remaining silent UR advocate could have requested the court for some more time for his arguments or else he could have submitted written arguments,which the court would have certainly granted.

Dear Jaime,
It may be your view that you have a very strong case.
Writ petition will be admitted by the court only if it is convinced that there are merits in the petition.
Therefore the court would have said either we will dismiss the writ petition or you may withdraw.
In order not to get dismissal of the writ petition, your Advocate might have opted to withdraw.
Therefore, one cannot blame the Advocate by saying that he was under-prepared etc., without knowing as to what your case is about for which you filed the writ petition.
