Advocate fees!

I am Thangadurai P residing at Chennai. My daughter's case is now in family court as her husband has filed a divorce case in 2009. So far only three counselling to the couple is done. No other remarkable improvement. Now we have changed our advocate for third time. The fees asked by the Advocates has no ethics or justification. They don't inform us any program or schedule of fees according to period of time or the stages of case. They don't even issue any receipt for the fees with details. We are not satisfied with the performance of the advocates as what they promise before taking and doing after that. But the fees demanded by them is very high as if we have to pay them salary every month. Every time the advocates demand not less than Rs.10000/- I need your advise or any guidance in this regard. Fix a fee with the advocate and insist on reciept in lieu of all money paid.

There is fix fees for advocates.You have to negotiate with your advocate and fix a fees before engaging him so in future there remains no chance of dispute.

pay by cheque and take receipt . you can rather than payoiing fees for entire case ask for quote for prepartaion of replies , evidence etc

Fees are negotiable, depending upon complication of casae. adv experience and demand, how all rated him etc. As u have wide choice, choose that suit your purpose and your pocket. Be clear, for fees, datewise + performance , in the shortest duration, no adjournment, etc.
Fixation of Fees are at the pleasure of parties, having benefits as well as it's disadvantages!

Dear Mr Durai,
You should fixed an amount for the entire case till it concludes.10,000 for every adjourment for a divorce case is very high.Ofcourse you have a right to demand receipt for the money paid.Not all but some selfish advocates try to squeeze the blood out of their clients.It is noty a healthy thing.

You must surely be a big person otherwise stakes must be high , so you pay and other expect high fees.
First decide the terms clearly otherwise just do not cry or blame people.

They seem to fix a fees take the amount and after some time, they ask for more fees. They never give receipt. They always want cash. The don't issue a promise to run the case with a fixed fees. When switching to other lawyer, he also demands the same. They don't have any sympathy on people come to them with distress. They want to make money out of our troubles. If we don't pay, they don't come to hearing or send some junior to get a date. These things can not be explained by mere words.

I have a great sympathy and concern for your case.Not all the advocates are selfish,but only a few of them and unfortunately,you have fallen into their hands.

Yes Sir, the things happen only with advocates practicing in Chennai High court campus. In other courts, the advocates fees are not that much expensive. The family court is in the High court campus here. Thanks for your sympathy. I am yet to find a good advocate. Often changing advocates become more expensive.
