Querist : Anonymous (Querist) 06 January 2012 This query is : Resolved

Is Affidavit of Exam in Chief taken on court's record as evidence?
Gift of property is allowed to the blood relatives; but the questions is whether the donor/donee will be required to pay court fee on it? if so, how much? Which one is better a sale deed or a gift deed?
ajay sethi (Expert) 06 January 2012

Gift of property is allowed to the blood relatives??YES IS THE ANSWER.

but the questions is whether the donor/donee will be required to pay court fee on it? YES IS THE ANSWER,NOT COURT FEES BUT STAMP DUTY /NON JUDICIAL PAPER.

if so, how much? ACCORDING TO STATE LAW.VISIT SUB REGISTRAR OFFICE OF AREA WHERE PROPERTY IS.

Which one is better a sale deed or a gift deed? ANSWER:IF MONEY HAS TO BE PAID THEN SALE DEED ,IF IN BLOOD RELATION WITHOUT MONEY,THEN GIFT DEED.
IN BOTH CASES REGISTRATION IS REQUIRED FOR ALL OTHER THAN MUSLIMS WHERE GIFT MAY BE ORAL ALSO.
