After expiry of leave & l, does occupier remains licensee or becomes tenant ?

(Querist) 02 August 2013 This query is : Resolved 
One of my occupier Registerd Leave & License expired on Mar12, threafter he requested orally for 12 more months and thus he had continued till Mar13, I again ask him to vacate or renew the license, (He signed the L&L but now he is refusing to register) In MhRC 1999 Registration is mandatory. Now my query is whether the occupier remains as LICENSEE or he becomes a deemed TENANT ? thanks in advance

a document which is not registered is in admissible in evidence . in your case the leave and license agreement expired in March 2012 and was orally renewed. licensee continues to remain in possession . if you file suit for eviction it would be his contention that he is a tenant .

The tenancy is month to month now and you need to provide a written notice for eviction.
