Agreement of sale of immovable property.

The owner of a flat executed Agreement of sale with the purchaser and handed over the vacant possession on receipt of 80% of the sale consideration and later on died without registering the sale deed. Whether the Legal heirs are bound to honour the agreement of sale executed by their predecessor ?

Yes, if it is a registered agreement. If they do not agree to execute the sale deed, file a case in court on the basis of the sale agreement.

The legal heirs are bound to honor the sale agreement on behalf of the deceased owner of the property.
If they do not cooperate then the buyer can approach court with a suit for specific performance of contract to enforce the sale agreement.

Buyer can get enforced the agreement from deceased's legal heirs through court and legal heirs will be bound to execute sale deed in favour of buyer and entitled to get 20% remainig sale consideration from buyer.
