Agreement with firm but cheque in the name of partner

(Querist) 01 February 2014 This query is : Resolved
Dear Sir

I have entered into agreement for construction of a house with a builder Firm represented by its Partner. Can I issue payment by cheque in the name of Partner instead of Firm name.
Whether such payment in the name of partner will be considered as payment to the Firm for all Tax matters(i.e as cost of construction of a new house)

Thanks and regards,

Issue of cheque in the name of individual partner cannot be considered as payment to the firm with whom you entered in to the agreement.

Agree with the experts, why you want to issue cheques in the name of partner instead of firm.

You have to issue the cheque in the name of the person with whom you entered agreement.

If you want to pay in another name, obtain a letter to that effect, from the other party.

The Author has not clarified why he want to issue cheque in the name of other person other than with whom he entered into an agreement.
