Hi,

We have agriculture land which we are cultivating from past 35-40 yrs. But that land is on some others name. This happened due to less importance to the paper work in old days. Now that person is trying to sell our land and not listening to us. He was assuring us till 2 yrs back that he will give our land, but now has turn his statement totally.

Please help me to come out of this situation.

Ashok Kumar Singh ji! How is it possible to legally claim ownership without any valid document in hand by filing a civil suit as you suggested?

Mr. Anonymous! You are advised to first obtain land documents of land under your possession since last 35/40 years till date and then approach any lawyer dealing in revenue matters. You may even approach me.

Only land documents shall set the exact line of your action as oral assurance has no value in the eyes of law. A situation may arise wherein the entire land may become yours property without incurring even a single penny. You show documents as soon as possible. Meanwhile you ensure your possession over land.

In such circumstances good remedy is suit for adverse possession.

You say you have been cultivating for last 30 to 35 years,then has any PARTAL entry made in your favor in these years,if yes then certainly you have a case of adverse possession.
