AIIMS has filled the post without Advt

I worked in AIIMS ON adhoc basis since 1997 and was terminated in Dec 2010
In between I had participated in the selection process held in year 2003 for regular appointment and was placed as waitlisted candidate. The authorities have not declared the result. The vacancy was created due to resignation of one employee but I was denied appointment for keeping mu candidature in dark. I filed the Petition (O.A) in year 2009 which was disposed off in year 2011. I have also challenged my termination in year 2011 and the order is reserved
In the counter affidavit filed by AIIMS of my O.A filed in year 2009, I came to know that AIIMS had filled the vacany to one candidate in year 2007 without any notification
Can I challenged his appointment by way of filing seaparte O.A by making that candidate as party alon with AIIMS who has filled the vacancy without any notification and given opportunity to me and other candidates?

Depends upon the notified rules of recruitment by the AIIMS, which only can clarify whether the organisation could make direct recruitment without advertisement in papers. Please check the rules of recruitment for the post first and then decide.

Respected Sir,
I have checked the recruitment rules .only one rule prevail there which you can check from the irregularities there in regular dailies newspaper
My termination was one of the outcome
Any way sir, whether CVC can investigate about the irregularities in regards to service matter, I have heard that CVC only handles cases related to corruption. "In reagards to filling of the vacancy to one candidate definately money has been paid to the authorites who has moved the file to the competent Authority and its was not the role of one person behind this becuase they have this notion together they will and can make the differnce"
I have the checked the file notings and they have highlighted in such manner that the decison of the competent authority was right
Whether moving to CAT will solve the problem? or first I filed complaint to CVC and then MOVE TO CAT? Or both things simultaneously
