Indian Air Force has made Air Force Order No. 04/2012 which tells that Airmen (Jawan) can apply for Group "A" job (GP-5400 & above) only after completion of 7 years of service.Airmen are placed in Group 'C' of grade Pay 1900 to 2800, JCOs comes under GP 'B' 4200 to 4800.It is not possible for everyone to become JCO So most of the airmen are in the rank of Sgts(Havildar) only. My question is why Jawans can not apply for Gp-B. Gp-B is also higher grade and that also gives career progression.It is a fundamental right of indian citizen to upgrade himself as per my opinion. Many writs have also made before the Hble Supreme Court/High Courts but all are in vein. The writs were for leaving the service after getting selected in Gp-B jobs.Most of the decisions are not favourable. Can you suggest me what can be now done against this AFO; I feel that this AFO is not as per the constitution. It stops our constitutional rights.

Nation incurred expenses on your training, you need to refund that by serving in defence. How it can be that if quit the job as per your will and wish. Defence personnel are released strictly in accordance with polices made by superiors. how AFO is unconstitutional, you need to prove before the court. Defence matters are generally least interfered by court, However, if any thing wrong to your service, AFT is the forum.

Advocate Sanjeev Kataria sir, Nation has expenses on our training it is true but nation has also made expenditure to make lawyer, police, doctor, engineer, banker etc. Everyone has shared the expenditure. We are not slaves, we are soldier to protect the nation. A man interest does not remain the same. When I join the service that time i had hot blood to do anything but now i do not want to the belt job. Is it criminal thought to leave the job or upgrade yourself? There must be timelimit when my training cost will be over. Please re-think on your opinion and think on ground of basic human rights.

1. You have ample opportunities in IAF to raise to be Class 1 officer, if you are able, competent and eligible as per rules. There are thousands of cases where jawans (Airmen) have rose to Air Vice-Marshal also. Work hard to achieve the target you can also be Commissioned Officer in IAF.
2. There is no bar in applying for a post of GP 5400 + through UPSC and proper channel some one has misguided you. Try your luck.
3. No one had sent an invitation to you to join IAF as jawan, it was your own initiative, preference, compulsion and decision. Whatsoever, you may continue in present job or seek discharge is your own choice and decision, apply and get out of IAF, there are hundreds of "unemployed" jawans available, ready and willing to join Indian Air Force. But while in IAF service you have no option but to follow service rules, regulations and procedures.
