Alimony claim on mortgaged property

Querist : Anonymous (Querist) 08 April 2018 This query is : Resolved
Hi,

Its very likely that me/my wife may initiate divorce proceedings soon. I co-own a property with my father. I & my father plan to mortgage/provide as a collateral this property for a loan. Once this property is hypothecated to the bank, can my wife claim any right on this hypothecated property during alimony proceedings.

Thanks in advance.

If your alimony is not sufficient your wife may claim to the extent of your share in that mortgaged property as alimony.or its equivalent cash.from you.

How is it likely that you and your wife would initiate divorce proceedings? Kindly avoid posting riddles; post real problem, if any.
