Allegations of impotency on husband

i have been living away from my husband for nearly 1 year since i was not interested in the marriage. i have alleged DV but not filed any case on him. this is my second marriage. my family has been frantically trying to bring my husband to MCD, but he is not accepting, so if i file DV can i make allegations of impotency on him ? we don't have kids from our 4 year old marriage. if i make allegations of impotency or allegations that he is unfit to father a child how can i prove them or my husband will be asked to prove himself ?

Filing a False / Fake allegation/ Complaint would make you eligible for a defamation Suit.

i don't have any medical evidence to prove his impotency so can i ask in the court to prove himself ?. there is a co-owned property for which i am not paying EMI, initially i paid around 3 lakhs but my husband is the one that is paying the EMI, can he claim the house and not return my share ? there is written evidence of abuse on my husband by my brothers how can my husband use it against me or my family, i am hanging out with my boy friend/ colleague and my husband has evidence of my mid night chats/SMS can my husband use it against me ?

Mr. Rajkumar has given good advice.
If don't have any medical certificate to
prove his impotency, and still you want to proceed or make allegations on your husband, then be ready to face defamation suit.

Problem may be with you as well. Get tested by a qualified Gynecologist and she would be able to say you are suffering from infertility due to some medical problem.First both of you go to different doctors sexologist your husband and Gynecologist you and blame your husband.

It appears that you are having misconceived notions as to impotency. Any standard gives the meaning of "impotency " to be -
:"A common problem among men characterized by the consistent inability to sustain an erection sufficient for sexual intercourse or the inability to achieve ejaculation, or both."

Mr. Venu i did not understand the relevance of your answer by the way since my husband is the only one paying EMI for the house can he claim the entire house as his ? even though i am working i am not paying EMI for the house

I agree with Venu. Erectile dis function or too fast ejaculation not facilitating sexual intercourse is the correct meaning of impotency.

Why not, if you can prove impotency of husband, nobody can restrict you in doing so. Mere leveling of allegation cannot prove his impotent.
