Adv Akhtar Ali Sheikh (Expert) 08 March 2011
Immediate lst degree lineal descendants with the parents and spouse (if living) can sell the property.
no need for grand children or children to be the party to the sale deed
A V Vishal (Expert) 08 March 2011
Under the Hindu Succession act the Class I heirs succeed to ancestral property, hence there consent is necessary for sale of the property, it is therefore advisable to include the legal heirs as consenting parties to the sale deed.
Advocate Bhartesh goyal (Expert) 08 March 2011
I agree with Mr Vishal.
G. ARAVINTHAN (Expert) 08 March 2011
All the legal heir need to be party to the deed so that none can question later
Sri Vijayan.A (Expert) 15 March 2011
I agree with Akhtar.
But they can be added as consenting parties to safe guard the buyer from future challenges
