Anticipatory bail - 498a 406

(Querist) 26 May 2014 This query is : Resolved
Hello Sir/Madam

I have got Absolute Anticipatory Bail in 498A 406 . F.I.R against my father was also registered in this case at Jalandhar Punjab..

My father is there in U.S.A well before filing of F.I.R in the case.

Now, after my Bail I.O has to submit Challan in the Hon'ble court.

1. Should I apply for my father's bail and make him join investigation/trial

2. Let challan being moved only for myself separately.

a) In this case my father can be made P.O. Will P.O effect his chances of getting bail latter, if he prefers to come before disposal of case to India.

b) Is it that hard to cancel P.O status later after disposal of the case

c) Will my father being P.O will have adverse effect on my Trial

Please suggest. Thanks

Apply for Quashing of F.I.R in behalf of ur father in high court U/S 482 Crpc and he is not required to come India for the said purpose personally!

it is advisable for your father to come to india and obtain AB . you should not wait for your father to be declared PO

High Court should be approached for quashing of the FIR.

Generally such FIRs are not quashed so better to contest the case instead of wasting time in quashing efforts.
