Sir, I am a builder constructed one apartment, and handedover the flats with fully finished works,registered the flats with fully compleated and handed over mentioned the same registered documents of all customer. constructed the flats under development agreement, outof 35 flats , 22fallen to my share, and rest 13 fallen to the landlord share, the issue is after 2 years 6 months they asking me to repair the leakages,in the apartment and other works. I am responsable for that, can they legally proceed further. what are their rights. please guide how to move. RAJ KUMAR REDDY,09248787879

you are responsible for rectifying leak ages in flat . claim can be made within period of 3 years . please cross check provisions of ownership of flats act of your state .

It is the responsibility of builder to rectify all defects in the constructions.Further the builder should obtain the mandatory occupancy certificate from the competent authority.A maintenance registered society will be formed as apartment owners association. All the common facilities and common areas of the apartment will be handed over to the maintence society.
