Apartment without terrace

Dear Sir,
I am a flat owner of xyz aprtment at solapur since 2007. In deed declaration the builder reserved rights on terrace mentioning if FSI granted in future he will construct flats on the terrace without any consent of flat owners. But he is contructing flats on whole terrace with tin roof. i.e. there will not be terrace in future. Please advice me is it legal for a builder to do so?

If the sane is without sanction of Municipality then file case for injunction against such constructions.

no,get stay order from court against him.

Builder has no right to encroach upon common terrace and this is illegal so immediately rush to civil court and obtain stay order.
