where state has filed appeal, as per the new cr.p.c amendment can a victim file another appeal before h.c. against order of acquittal?
prakash vathore (Expert) 22 January 2010
victim is represented by the state coz every person belongs to the state and if the state has preffered an appeal then no need to file a seperate appeal by the victim.
Adv ramesh chheda (Expert) 22 January 2010
victim can appoint his advocate as watching advocate to assist state prosecutor in appeal and of finds that appeal is not drafted in proper manner then he can ask prosecutor to carry out necessary modification. if prosecutor is not willing to do that in such a case, can apply to court to intervene in the matter
Bhumik Dave (Expert) 23 January 2010
victim can apply for with prosecution.
B K Raghavendra Rao (Expert) 23 January 2010

Victim cannot file a separate appeal against acquittal when the state has done so. At the best, the victim can seek permission of the court to permit him to appoint his own advocate to pursue the matter, if for reasons it could be shown that the public prosecutor is not in a better position to fight the case.
