Application for summoning the witness was not allowed as his name was not given in the list of witness. My query is can appeal to higher authority.

If the name of witness could not be included in the list filed and application for calling essential witness shall be moved to higher Court U/S 311 Cr. PC and / or Order XVIII Rule 17 CPC
