A civil suit was filed in the lower court for removal of fraudulent registrations made on property. Since the respondents did not turn up for the hearings, the court has announced ex-parte judgment. It is said that if the respondents want to appeal against the ex-parte order, they have to pay the fees to the court equivalent to that of the stamp duty of the property value. Is it so ? Can you please confirm this ?

Appellant has to pay the same court fees which had been paid by plaintiff on suit.

Simply apply for setting aside decree on the ground that you were preventrd by sufficient reasons from appearing in the court to make a defence if it is bonafide.and justifiable. Otherwise you should go for appeal and to pay court fees as has bern paid by the plaintiff in the lower court but in such a case you cannot make out justification for your abscence in the lower court
