whether ESI registration is applicable on charitable trust though various precedents such as BOM HC have observed that co-operative societies do not require ESI registration?

Your case is not covered under the mentioned citation of Bombay High Court. You are running a charitable trust whereas the citation pertains to co-operative housing societies.

If your trust has employed more than 10 employees on any working day on the work which comes within the definition of factory then your trust is duly required to be registered under ESI.
