application for expert/handwriting expert dimissed as withdrawn on the statement of counsel of accused in the presence of accused at the stage of cws in complaint u/s 138 nai 1881.At the time of dws same application was moved once again,is application maintainable.

A 2nd application can not be moved for an earlier application dismissed as withdrawn unless withdrawal was due to some technical defect and while withdrawing liberty to move a fresh was granted or some new ground other than one pleaded in earlier application has emerged subsequently.
