Dear Experts,
Mr. X is an advocate. A flat in Co-operative Society, Mumbai is in the name of Mrs X. who is also a member management committee.
Can the society appoint Mr. X, an advocate to represent the society? Does it amount to conflict of interest? Because Mr. X & Mrs. X are creating lots of problems among the members through continues litigation.
Thanking you,
Regards,
ajay sethi

for appointment of an advocate resolution has to be passed in managing committee . when the resolution was placed for voting Mrs X a member of MC cannot vote . if other members have no problem in appointment of Mr X as advocate of society and has been approved in MC then resolution would be binding on members of society .
if you are aggrieved raise issue in AGM to set aside resolution passed by MC
