(Querist) 01 October 2012 This query is : Resolved 
when there is no partnership deed and registered partnership deed matter is pending before the civil court and at the same time matter is pending before the arbitrator. Can the arbitration settle the dispute when the matter is pending before the civil court can the matter be referred to the arbitrator when there is no registered partnership deed

The civil court has no jurisdiction to try this dispute when there is a arbitration clause in it.
The court on its own or at the instance of either party can refer the dispute to an arbitrator.
In resolving the dispute amongst the partners inter se the deed need not be registered.
