It is a question of ethics and morality, since in case it comes to the knowledge of the bank, the bank can block the account till such formalities which are necessary in event of death of the account holder is completed
Sarvesh Kumar Sharma Advocate (Expert) 24 August 2009
Neelkshi,
legaly not.
Kiran Kumar (Expert) 24 August 2009
technically not....after all ATM card is an imortant insturment to operate account and its ownership must change after the death of the real account holder.

but when the account holder dies the account has to be closed, so does the ATM card.
Bhumik Dave (Expert) 24 August 2009
Agreed with kiranji.
Jayashree Hariharan (Expert) 25 August 2009
no you cannot, because you are not the account holder. simple. approach the bank for closing the account of the dead person. otherwise, the person who uses the atm card will be held responsible legally. morally, it is not right to use it, as we all know, am sure.
