I have filed a sec 138 case(n i act )(cheque bounce ) against a person who is a defaulter of Rs 32 lakhs ....In course of case proceedings the accused has surrendered and took the bail on the basis of summons of the ld court . but now the person is trying to sell his all properties and might move abroad...what remedy you prescribe.
Devajyoti Barman (Expert) 03 April 2014
In this case you have remedy.
You have to file a civil suit for money where you can file petition for attachment of property before judgement.
Priyajit Purkait (Querist) 04 April 2014
32 lakhs will attract heavy court fees .................is there any other remedy.....civil or criminal.............
ajay sethi (Expert) 04 April 2014
it is better to pay court fees than having accused sell his property
Devajyoti Barman (Expert) 04 April 2014
If case is in WB then highest court fees is Rs.50,000/-.
