Querist : Anonymous (Querist) 24 November 2011 This query is : Resolved
sir i am working as a govt servant one of my superiors is threatening me to sue me under the SC/ST attrocities act and saying i will fabricate case against you that you have insulted me in front of so and so and he willbe witness and you will be arrested and you will be suspended from job and put to lat of hrdship. i would like to seek anticipatory bail is this possible can i also claim immune from attrocities as my marraige is intercaste to establish that i have no caste differences and he is making false complaint what is the way out. how to avoid arrest can anyone please suggest as the threat is looming large

Where do you stay as in most places anticipatory bail is not available before actual lodging of complaint.
However I think you better first lodge a complaint to the Police about such intimidation.

I agree with Barman

The provision of AB doesnot exist in SC/ ST Act.

Better record these threats and keep the recordings safe.

You are receiving only threats as on day so you make a complaint to police to take strict action against such person. AB bail can even be applied under this special act but as there is no FIR as on date so only a notice bail/arrest can be provided to you.

Proceed as advised.
