hello sir, can u please advice me what argument should i do before the court to get out of my client from police custody. facts of the case is as under-
one mr.X interested to purchase a land nearby titwala,tal.kalyan dist.thane. so he met accused person. accused told him about one land and told the price Rs.8,00,000/-. he agreed . and accuse person told the complainant i.e Mr.X to deposit the whole money in to accused bank account. as per the request complainant deposited the same. accused prepare one false sale deed agreement which mentioned origional land sellers name as a saller and complainants name as a purchaser. and madhe that document only notorised. and gave it to complainant. complainant is not knowing the ori.land owner but he took that document given by the accused. but after some days he knew that he is not the owner of the land . the owner on 7*12 extract is still another person. It menas accused made a false document and withdraw the whole money from his account . hence complainant lodge a complaint in police stn. so police arrested the accused. now one first date court gave 4 days police custody. now 27.6.2013 is the next date.
so my all seniours please advice me which type of argument should i do before the court so that court will remanded him to Magistrate Custody.

After recovery of money fradulantly obtained by your client from the complainant, the court is bound to send him to judicial custody, No specific argument is required for that purpose. Don't expect regular bail as of now.

rightvsir. thanks. but right now. recovery is not done. client dont have money to give to complainant.
and now he is in police custedy. i want to get him out of the pc to mc
.
