Bank loan auction

(Querist) 24 December 2014 This query is : Resolved 
I have taken a rent home at Ahmedabad. Now few days before HDFC bank officer came with police protection to take possession of home. Actual matter is that my owner bought home through cooperative bank in auction. And earlier owner take two loans from bank one personal loan from cooperative bank and one loan from HDFC bank against property. Before auction add given by cooperative bank in news paper.

My owner not had given possession of home to HDFC bank. Now HDFC bank file petition against all including me in police station. Now every day police call me to police station and tell me that you have to came court for bail.

Now suggest me what to do?

Approach an able lawyer with all documents that you have and proceed further under expert guidance of your lawyer.


M/s HDFC bank would want to have charge on the property against which a loan was granted.....and would use all kind of tactics......and your lawyer can defend your interest....

Your lawyer may advise to obtain thru RTI all docs submitted by M/s HDFC bank and to include the Co-Op bank amongst list of noticees.......

since you have taken premises on rent terminate your agreement and hand over possession to flat owner .

The premises is on rent with you. If you wish take stay on your physical possession of the flat being a tenant, Bank may proceed to take symbolic possession.
