Bank statements as evidence for financial capability

Dear Sir, My sister is having a Divorce and Domestic Violence case against her husband.
Her husband states that he does not have any source of income to provide financial support to his dependents. if she gets the bank statements of her husband's bank account on request basis, can these bank statement be produced in court as evidence to show his financial capability.
if yes , pl inform how.

Certainly, you can produce it. Anything would work like salary slip, ITR, Bank Statement etc.

What is the opinion of the lawyer hired for your sister's maintenance & dv case?

Further, are you sure your sister's husband is having a fatty bank account with frequent deposits of his income?

Bank account proves only financial transactions and not necessary it is income of your husband. you require some more like 'the amount Rs 52698/- in bank statement is for his salary and his salary slip is this which show the same amount.' So you require bank statement as well as supporting documents of the transactions.

Dear sirs,
Thanks for the replies.

Pl provide me knowledge of some cases in which such ON REQUEST bank statements are put up as evidence in court.

He has a fatty account. Curently active. Big deposits are seen received in bank as his entitlement of retirement benefits.

Information through RTI was requested from the bank and IT department but was not given stating as third party and confidential information.

Pl provide some cases which states as such statementshort are accepted by the court.

If you expect the experts of this forum to provide you the case, what the lawyer of your sister will do?

Also, you have not replied my last question, "What is the opinion of the lawyer hired for your sister's maintenance & dv case?"

Still further, when your sister has not been able to get the information even through RTI, what does it means by your statement, "if she gets the bank statements of her husband's bank account on request basis?"

All these ambiguities hints toward some hypothetical academic query, not a real problem.

Dear Sir
Hired lawyer says the statement of bank obtained from an inauthentic source cannot be submitted as evidence.
The case for info is taken up with CIC under RTI act.
If you know any manager of bank you can get the account information easily.
I hope you can reply with cases as examples.

Your lawyer has rightly informed you. Statement taken through RTI or through influence won't work. That will be your futile effort.
