I am from Mumbai-India,
I entered into contract for purchase of goods from party KJGOLDEN in Nicosia-Cyprus, this KJGOLDEN sent me proforma invoice with the bank details for payment to their account.This proforma invoice was hacked thru my mail, and hacker changed the bank details , however name of co. remained same i.e KJGOLDEN, based on hacker proforma invoice i authorised my banker for remittance in favor of account name KJGOLDEN with account no.and to bank NATWEST-LONDON as provided by hacker, My banker Central Bank FOREX, thru swift msg remitted the amount to Natwest for credit to the account no.mentioning name of account KJGOLDEN.
I realised after 15days about this fraud of hacked invoice and remittance to wrong account no.and immiiately asked Central Bank to stop payment and recall funds.central bank immidately sent swift message for stop and recall payment.
NATWEST replied NO FUNDS REMAINS AND PAYMENT CREDITED TO KJGOLDEN- MATTER CLOSED.
Centralbank at my request again informed them that account no holder is not KJGOLDEN and therfore funds be returned also asked Natwest OF ACCOUNT NO kyc details which nawest refused on pretex of data protection and customer confidentiality rules as per uk laws
MY QUERY IS
is NATWEST right in crediting the amount to said account no. without verifying and matching the name of account in whose favor remittance was authorised?
is NATWEST not duty bound to match name with account no before crediting fund as per swift advice?
can NATWEST deny detail of account, who has recived the funds, and is this not crimnal breach of trust by reciptant funds.
what remedy i have to recover the funds?
can i file suit in mumbai against NATWEST and the account no. who recived the fund?
