Birth certificate

(Querist) 14 September 2010 This query is : Resolved
Dear Experts, my client recently adopted his brother in law's child. The child was born at Vellore Dist. in Tamilnadu and the birth has been registered there. The adoption ceremony took place in Pondicherry and the adoptive parents also reside in Pondicherry. Hence I drafted an adoption deed and got it registered at Pondicherry. Now the adoptive parents want the birth cerificate to be issued mentioning their names as parents. What is the procedure and relevant act and rules and citations if any?
R.Ranganathan (Expert) 14 September 2010
Birth certificate is given showing the names of the natural parents only. The adoptive parents will have to show the adoption deed wherever required.

Yes based on the adoption deed competent authorities are legally bound to issue the Birth Certificate mentioning both the names of parents (natural and adopted)

Dear Parthasarathi Sir, could you please give me the relevant act/rule or any citation. Thank you.
s.subramanian (Expert) 14 September 2010
No. It cannot be done. Birth certificate is issued as an extract of the Birth Register maintained by the local bodies. It will contain only the names of the natural parents alone. There is no provision in the Birth and Death Registration Act to make an entry of the adoptive parents in the birth register after any such adoption. therefore it is impossible to incorporate the names of the adoptive parents as desired by your clients. On the other hand they can get a valid sanction for such adoption by filing a civil suit seeking a declaration in this regard.

I fully support the views of Mr.Subramanian in this regard.

By keeping the copy of adoption deed, one can claim to be a parent only.
