In a divorce case where husband is respondent and don't want divorce, in the absence of communication with the wife, can husband give an advertisement in news paper with photographs wishing his wife on her Birth Day and Marriage Anniversary? or put banner in the city with local municipal corporation permission? (We both are living in the same city.) Issues have determined by the Court and case is now at witness stage.
If yes, Can wife take action against husband? or she lodge Police NC Report? or inform to the Court where case is going on? On her information can the Court suo moto take action on the husband? What kind of action every one can take? under which act and section?

The act is not a penal one. though the matter is pending in court the petitioner and the respondent still husband and wife. But the wife can make that your activities made her mental agony. based upon the family court cannot take any action in this regard.

IT IS NOT BAD IF YOU WISH YOUR WIFE,EVEN IF A DIVORCE IS PENDING,BUT THE WAY YOU WANT TO DO IS NOT JUSTIFIED,HAS THERE BEEN SUCH A CLASSIC WISHING ON YOUR PART,BEFORE THIS CASE WAS NOT FILLED IN ANY OF THE YEARS IN PAST.
CERTAINLY,COURT IS NOT GOING TO GIVE YOU ANY GRACE MARK FOR IT,ALBEIT,MAKING IT EVIDENCE,YOUR WIFE CAN PLEAD YOU MADE FUN OF HER PUBLICLY, WHICH HAS CAUSED FURTHER INSULT AND AGONY TO HER.
