Bombay rent act

(Querist) 10 June 2013 This query is : Resolved 
i have taken a shop on rent in the year 1999 of which effect the Leave & License agreement duly executed between me & Licensor for the period of 11 month. after expiration of 11 month i am in continue possession of said shop till date & paying monthly compensation. but now the Licensor force me to vacate the shop without any notice. what r the remedy available for me as i have settled the good business in said shop?

it appears that leave and license agreement has not been renewed but you continue paying license fee to licensor .
it is the biggest mistake licensor has made . let licensor take eviction proceedings against you .continue to be in possession

take stay order from civil court.

You are licencee means a tenant and the licensor can definitely get the eviction order from the Rent Controller so it shall be better for you to settle the fresh terms and conditions with him.

It depends in which state you are located., since in many state laws it is mandatory for landlord to execute agreement for lease or tenancy.

Since you are in possession for more than year and agreement not renewed you can claim tenancy but far which you have to go to court first and outsmart the landlord.

If you do not go first to the court tables can be turned against you.

You should engage expert legal person who has handled similar cases, others will be of no use.
