The previous secretary went to the registrar as the chairman and the treasurer were not co-operating with him with respect to the accounts of the society nor were they attending any meetings of the society a lot of misappropriation of money had taken place by the chairman and the treasurer and were trying to pass the buck on the Secretary. A new managing committee was formed the registrar successfully handed over all the papers to the new managing committee. The Old chairman and treasurer continue not to attend any meetings however the ex-secretary makes it a point to attend the same. Next month the new managing committee will be holding an AGM with respect to the accounts. Will the Ex-secretary be harassed over this. This person has faced a lot of mental anguish because of this for no fault of his. How can the ex-secretary protect his rights.

if there is no misappropriation of fuds by Secretary h has nothing to fear .

in respect of all cheques secretary signature is a must .if he has signed the cheques then he is party to the fraud .

if however none of cheques have been signed by him and all cheques bear Chairman ? treasurer signature and there is misappropraition by these 2 signatores society will file police cmpalint against them and seek to recover money misappopriated

No scope of harassment of the secretary in the AGM if he has not approved the accounts, which he thinks form part of misappropriation of funds. But, if the AGM insists approval of accounts by the ex-secretary, he would have the discretion to dispapprove any expenditure which he considers part of misappropriation of funds.
