Booking flat

I ramesh more,bought a 1bhk house 668 sq ft at veera desai andheri west, agreement value is 16,70,000/-. agreement & stamp duty was done on april 2005.

the builder has not build the same post plinth work.
some mhada case was there and is now cleared.

the builder is not even contacted us once in all those years even by telephone or letter, every time we go to him he answers work will start in 3 months.

nowin sept 2011, the builder has entered a joint venture with a developer and the construction is about to begin in 3 months.

in this new scenerio will we get the said flat in the same value as per the agreement?, what is to be done by me to get my flat legally?

we want a home from him.
pls tell us what can be done?

have you entered into agreement with builder?

was payment made by cheque? or cash?


what were terms and conditions of agreement?

you will have to issue notice to builder that your rights sould be protected .

ask builder for copy of agreement he has entered with other developer.

you ought to have filed case against builder within 3 years ie by 2008 if he had failed to deliver posession .
