Breach of trust on land purchase

(Querist) 05 June 2013 This query is : Resolved

Dear Sir/Madam,
I purchased a plot in dehradun through property dealer/broker.As property seller (owner of land) and property buyer (I) were never allowed to met until the date of registry of plot (to know the exact location of the land of the owner),the broker sold us the different location.Later on,when it came to our knowledge, we asked for the redressal of the wrong. He assured us by saying that he will get the plot registered with the correct/real owner of the land but first we have to sell/transfer the previously registred plot.We as a seller of the previously registred plot sold the plot to a person whom he hold.Actually, we relied heavily on broker and thought he will get the plot registred with the real person so that the location of the plot for which we paid the money is sold/registred by the correct person in our name. Now,broker is delaying/procrastinating by saying he has to talk/convince his other partners in company.Actually, broker has some partners and they purchase a big land and do plotting. They have not provided the roads etc things which they promised before purchase of our plot. Now, we see them reluctant
to provide any of the promised things. Please help me to know -
1)what can I do to press them to register the land in our name with the correct
person.2)Or to recover my money 3)legal aids I have to stop the further processing of the registry of plot (which we have done on trust) from us to another person on trust of broker (that broker will get the plot registred in our name from correct person)4)Tax implications on selling plot to another person on broker trust as we have not taken any money thinking that
broker will get our plot registred with the correct person.5)Any other relevant things we should take care and your opinions. And how should we proceed now.my mail id is anodon@gmail.com.
Thanks & regards,

you need to contact a local lawyer . it is necessary to go through the case papers to advise . issue legal notice . file criminal complaint against seller .
